Can estate planning avoid guardianship or conservatorship?
Sometimes, yes.
Good powers of attorney, health care documents, trusts, and beneficiary planning can often reduce the need for court involvement if someone becomes incapacitated.
No estate plan can prevent every possible court issue, but proper planning can make it much easier for trusted people to help without needing a guardianship or conservatorship.
